Cyclist Killed in Brooklyn Crash

A bicyclist was hit and killed in Prospect Park in early October, according to the NYPD. Both the cyclist and a Peterbilt tractor trailer were traveling eastbound. The driver of the tractor trailer suggested the cyclist “probably hit” a parked car, and “fell into his truck.”

13 other cyclists have been hit and killed in New York City this year, highlighting the dangers of biking alongside heavy traffic. Here’s what you need to know if you’re injured in a bicycle vs. vehicle collision.

Negligence and bike accidents

Because autos are much heavier and faster than bicycles, they pose a significant threat to cyclists. Even cyclists who follow safety precautions and bike laws perfectly can be injured in an accident.

When an accident occurs, cyclists may be able to recover compensation for their injuries, property damage, lost wages and more. Vehicle and bicycle accidents usually proceed under a theory of negligence.

To prove a vehicle driver was at fault, plaintiffs must show:

  • The driver had a duty of care to the plaintiff,
  • The driver failed to meet that duty,
  • The breach of duty caused the accident, and
  • As a result, the plaintiff suffered actual harm.

What to do after a bicycle accident

Bicycle accidents should be treated much the same as car crashes. First, call law enforcement and 911, if anyone needs immediate medical care. Do not discuss your injuries or the accident with the vehicle driver.

If you’re physically able, take photos of the scene and your injuries. Take note of the time and date the accident happened, the weather conditions, exact location and what occurred. If there are any eyewitnesses, ask for their contact information.

Exchange contact information with the driver, and get their insurance information. Next, seek medical help, since many injuries do not manifest for several hours or even days afterward.

Finally, call an experienced personal injury attorney. You may be able to recover compensation for your injuries and more.
